Terms of Service

1. Agreement to these terms
These Terms of Service ("Terms") govern your access to and use of the Propel platform (the "Service"), operated by Main Street Assist ("Main Street Assist," "Propel," "we," "us," or "our"), accessible at mypropel.ca. By creating an account, or accessing or using the Service, you agree to these Terms on behalf of yourself and the business you represent ("you" or "your"). If you don't agree, please don't use the Service.
2. What Propel provides
Propel is a business-management platform built for solo and small service businesses. Depending on your plan, it may include:
- A CRM for tracking contacts, leads, and customer conversations.
- A calendar and online booking system.
- A website builder with hosting and custom-domain support.
- A chat and voice assistant for your business.
- Task, email, and related productivity tools.
We may add, modify, or discontinue any feature at our discretion as the Service evolves, and not every feature is available on every plan.
3. Eligibility and your account
You must be at least 18 years old and authorized to act on behalf of the business you register to use the Service. You must provide accurate information when creating an account and keep it up to date. You're responsible for keeping your login credentials secure and for all activity that occurs under your account, and you agree to notify us promptly at info@mypropel.ca if you suspect unauthorized access.
4. Your data, and your customers' data
Some of what you store in Propel is about you and your business ("Account Data"). Other information — CRM contacts, leads captured through your website's contact form, calendar bookings, and chat conversations from your visitors — is about your own clients or customers ("Customer Data").
For Customer Data, you're the responsible party: you decide what to collect, you're responsible for having a lawful basis and any consents required in your jurisdiction, and you're responsible for your own privacy notice to your customers. We process Customer Data solely on your instructions, to provide the Service to you — we won't use it for our own independent purposes, sell it, or use it to train models across other customers' accounts. 5. Your website and published content
If you use Propel's website builder, you're responsible for the content you publish — text, images, testimonials, embedded video, and any third-party scripts or tracking pixels you add. You represent that you own or have the necessary rights to everything you publish. Content must be lawful, must not infringe anyone else's rights, and must not be deceptive, hateful, or harmful.
We may remove content or suspend a site we reasonably believe violates this section or the law, and we'll try to notify you when practical. Custom-domain connections depend on DNS records you control; we're not responsible for delays or failures caused by your domain registrar or DNS provider.
If you believe content hosted on the Service infringes your copyright or other rights, contact us at info@mypropel.ca with details of the material and your rights, and we'll investigate and take appropriate action.
6. Chat and voice assistant
Propel's chat and voice assistant generate automated responses based on the information and instructions you provide about your business. They can be wrong, incomplete, or out of date, we don't review each individual response before it's sent, and they're not a substitute for your own professional judgment — this matters in particular if your business provides licensed or regulated services, such as counselling, coaching, or trades work covered by local codes.
You're responsible for reviewing how the assistant represents your business, for correcting or disabling it if it misrepresents you, and for making sure its use fits your profession's rules and your own standards of care.
7. Acceptable use
You agree not to:
- Use the Service to send unsolicited bulk messages ("spam").
- Collect Customer Data unlawfully or without required consent.
- Attempt to disrupt, scrape, or reverse-engineer the Service.
- Impersonate another person or business, or misrepresent your affiliation with any person or entity.
- Upload malware or attempt to bypass security measures or rate limits.
- Resell, white-label, or provide the Service to third parties without our written permission.
- Use the Service to harass, defame, or harm any person, or for any illegal purpose.
We may suspend or terminate accounts that violate this section, including immediately and without notice where we reasonably believe there's a security risk, legal liability, or harm to us or others.
8. Fees and the free period
As of the effective date above, new accounts are free to use for the first 6 months from the date of signup (the "Free Period"). We may change, extend, shorten, or withdraw this offer for new signups at our discretion, with reasonable notice on our website — it doesn't change what's already been offered to existing accounts.
After the Free Period, or for any paid plan or feature we introduce, we'll show you the price clearly and won't begin charging you without your affirmative agreement (for example, adding a valid payment method and confirming a purchase). Fees are exclusive of applicable taxes, which you're responsible for. We'll give existing paying customers at least 30 days' notice of any price increase.
9. Third-party services
Propel relies on other companies to provide parts of the Service, including Resend for email delivery, Google for sign-in and calendar sync, one or more language-model providers (such as OpenAI or Anthropic) for the chat and voice assistant, and our cloud hosting providers. These providers process data only to the extent needed to provide their part of the Service, under their own terms and our instructions. We choose these providers carefully, but we don't control their services and aren't responsible for their acts or omissions beyond what's required by applicable law. 10. Intellectual property
You retain ownership of your business content — text, images, and data you upload. You grant Propel a limited license to host, store, transmit, and display that content solely to operate the Service for you. Propel and its licensors own the Service itself, including its software, design, and trademarks; nothing in these Terms transfers that ownership to you.
If you send us feedback or suggestions about the Service, you agree we may use them to improve Propel without any obligation to compensate you.
11. Indemnification
You agree to indemnify and hold Main Street Assist harmless from claims, damages, and reasonable expenses (including legal fees) arising from your content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.
12. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your account for violating these Terms, for non-payment (once paid plans launch), or if required by law. If your account is closed, we'll give you a reasonable window to export your data before it's deleted, except where we're required to delete it sooner.
13. Disclaimers
The Service is provided "as is" and "as available." We don't guarantee it will be uninterrupted, error-free, or that it will meet every requirement of your business, and to the extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
14. Limitation of liability
To the extent permitted by law, Main Street Assist won't be liable for indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim will not exceed the greater of (a) the amount you paid us in the 12 months before the claim arose, or (b) $100 CAD.
15. Force majeure
We won't be liable for delays or failures caused by events beyond our reasonable control, including outages of third-party providers, natural disasters, or internet or infrastructure disruptions.
16. Governing law and venue
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree that any dispute arising from these Terms or the Service is subject to the exclusive jurisdiction of the courts located in British Columbia, Canada.
Before filing a claim, you agree to contact us at info@mypropel.ca and give us 30 days to try to resolve the issue informally.
17. General provisions
- Severability — if any provision of these Terms is found unenforceable, the rest remain in full effect.
- Waiver — our failure to enforce a provision isn't a waiver of our right to do so later.
- Assignment — you may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
- Entire agreement — these Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service and supersede any prior agreements on the subject.
18. Changes to these terms
We may update these Terms from time to time. If we make material changes, we'll let you know — for example, by email or an in-app notice — before they take effect. Continuing to use the Service after that means you accept the updated Terms.
